Jan Brewer's attorney's know it also. One has to keep in mine AZ attorney general a democrat who's considering running against Brewer in Nov is opposed to the AZ law.

Even though an injunction blocked several points of the AZ law, I think Jan Brewer thought she was going to get a favorable ruling. The law did go into effect somewhat compromised. It might have been the strategy from the start.

I didn't see the WH do a victory dance, and the protesters (small in number)came out any way.
The liberal media declared a victory :roll:.

The problem with trying to back-step the AZ defense is the time it takes to get the SCOTUS to take up an 'Original Jurisdiction' case.

Had AZ filed a Motion for Dismissal on Jurisdiction grounds in the 1st instant Bolton might well have granted it providing her self the relief of not having to hear and decide on the issue.

Then the DOJ would have been forced to file at SCOTUS, under Rule 17, if they wanted to pursue it.

So I do agree with the analysis, but believe it is an uphill battle NOW to attempt to leap frog BACKWARDS after already accepting the Jurisdiction of the USDC AZ in the 1st instant.

Rule 11 of SCOTUS provides for a faster track to SCOTUS than 'Rule 17 Original Jurisdiction' now anyway.

But again, having NOT argued 'Jurisdiction' to begin with, doing so now is barred at USCA 9th Circuit and a Petition for Rehearing at the USDC AZ, (Bolton Crt), would be the only way to get it in at the USCA, all of which would be time wasters compared to Rule 11.

Why the forty copies? And who are they all supposed to get served to?


They are disbursed to the 'Clerk interns' of the Justices as well as the Court Clerk and the various other Parties to the Action.

In my case, being 'Pro Se, In Forma Pauperas', only 11 copies were required, 2 to the Court Clerk with the other 9 going to the Clerks of the Justices.....

....with the amount of work-load sent to the SCOTUS, EVERYTHING goes through the 'Clerks' first.......... necessary on the one hand, subject to abuses on the other........


...in the divided court we have the Clerks of the 'Liberal Judges' are looking to undermine any case that is harmful to their "Politics' whereas "Conservatives, more often than not, simply look at the Constitutionality and 'justice' issues.....

i do believe that there are steps to follow..ex. Procedure.. GOV Brewer now has to appeal to the STATE SUP.COURT..which is in SAN FRANCISCO i do believe..and they are AS LIBERAL as judge bolton..Then I do believe it will move to the US SUP COURT which could take years...???

What you are referring to in San Francisco, is the 9th Circuit Court of Appeals, a Federal court - then it can go to the U.S. Supreme Court.
It sounds like Brewer may attempt to change some of the wording of the law, and try again. There is mention of her rewriting the law.

Thanks Martha...I knew I had the courts mixed up..I guess when they are all run by LIBERALS they tend to resemble each other..lol
And Yep I did read that GOV BREWER may try to reword it..but I think she should stand firm..and move past BOLTON..as Bolton is just another Clinton LIBERAL...who could care less about upholding the laws..and is looking to keep her party of POLITICAL Friends alive and kicking in the next election.. thanks for the corrections... :o)

By pure coincidence, we'll be in AZ, Bullhead City, Flagstaff and Phoenix at the end of the month.... One of my buddies is now a deputy with Coconino County...interesting guy.

My point is that the average guy out there in AZ is saying screw the courts... and they will protect their homes and family.


So, La Raza can go ahead and "Raza Hell", but they'd better get familiar with the term "Blow Back"...

If the cops have just been neutered..... And it could end up becoming "Open Season" in the desert.

I am convinced more than ever that Our Fuhrer will sneak Amnesty through, one way or another.... in the next 30 days. Executive Order is most likely... Although piggybacking it as an Amendment to a Passed Bill would be just as likely...
Which is what they were trying to do with 9/11 Bill for aid to Rescuers...

Can't be repealed.. It is as if Mexico has one the War on America... "Give us Your Treasury! You can keep our downtrodden and weak..."

I have two legal opinions which are attached. However, in spite of this, some folks continue to promote concerns that are not in the bill and are already prohibited by law and the Biggs amendment will even
make clear and prohibit Arizona from participating in any form of national
ID.

I have spent several hours working with Governor's Office, F.A.I.R. to address these concerns and others. I have put words in which will be in the amendment Wednesday, prohibiting a form of National ID or
radio chip of any kind as indicated in the Obama plan for new ID.


I also will strengthen the civil rights provision that is already in the bill to prohibit any racial profiling. I have also strengthened other areas of concern. I also added language to make sure
the verification of information is about aliens and the transportation part
is for those in furtherance of an alien remaining in the U.S. such as sanctuary
movements or smuggling and NOT a little ole lady taking someone to church or a
good Samaritan or any emergency medical needs. In 25 years there has never
been a prosecution of anyone for simply taking someone to church, a church
outing, boy scout outing, etc. I am disappointed some continue to ignore
the simple and plain language in the bill.

SB1070 is the most comprehensive enforcement bill in the nation, it will remove all "illegal" sanctuary policies that exist in many of our cities, and it will allow law enforcement to enforce our immigration laws as
intended.

I guarantee this will save lives, American jobs, reduce the cost of government, improve neighborhood safety, improve congestion, move toward smaller classrooms, shorter lines in emergency rooms, reduce rapes and
molestations and reduce the number of deaths and maimings of our citizens and
more.

Please note that Phoenix has had a more than 50% reduction in homicides this year over last year, after we passed employer sanctions and other illegal alien legislation, and our illegal alien population
has decreased by twice the national average in the past two years saving lives
and hundreds of millions of dollars in services.

SB1070 will add a "trespass" provision to law enforcement giving them the ability to hold an illegal alien under state law if need be or to just a phone call to ICE and turn them over to ICE.
This provision will allow our law enforcement folks to complete
investigations on a suspect and not allow them to be deported before the
investigation can be completed. It also goes after illegal employers and
illegal aliens soliciting work and provides for law enforcement to more easily
enforce public safety issues on busy streets.

AS I have promised: SB1070 will be amend to clarify issues of concern,
but will not be weakened so it jeopardizes our ability to enforce our laws
appropriately and withstand future court challenges by the normal
suspects.

I must admit, I am disappointed in some folks who have expressed unwarranted concerns in my opinion. I have worked for over 30 years to protect states sovereignty and in defense of our Republic as intended
by our Founding Fathers. You would think after years and years of caring
the torch of freedom, states rights, limited government, in defense of
Constitutional government in defense of Life, Liberty and Property some would
have a little more trust.

To be sure, I have asked for additional legal opinions and have been assured by several competent independent Constitutional attorneys, legislative council attorneys and the Maricopa County Attorney's Office that my
interpretation is correct. However, I want to be very clear and will add
language to eliminate those concerns as best as I can.

We have already passed legislation to prohibit the State of Arizona from participation
in any kind of National ID or Real ID Act and it is current law. This
bill did not and does not change that. Having said that, I will put
language in the bill that enhances the clarity on these issues of concern and
make it very clear that nothing in this bill will allow Arizona to be a part of
any national ID program. There will be similar language to deal with
concerns over improper or prolonged detention. I have had Legislative Council and the Maricopa County Attorney's Office examine
this legislation and both have assured me it does allow for any kind of National
ID or expand ID requirements in any way. I have also attached the letter
from the MCAO that answered my questions. I am also pasting the legal
opinion from the Arizona Legislative Council at the bottom of this
email.

I will make some changes (in the Biggs amendment) to protect the first responders and those good Samaritans transporting illegal
aliens (little old ladies taking someone to church) are not in jeopardy in any
way. They are not now under this bill, because they must be committing an
additional criminal offense to the state law to be so charged, but I will make
it even clearer in the new language.

We should be able to have this bill heard the first of next week on the House floor for COW and 3rd Read.

I will keep you appraised on our
progress.

These Illegals come in here EVERYDAY..THEY STEAL AMERICANS IDENTITIES, THEY commit crimes, they Get Free healthcare, they dont pay a dime in taxes..WE FOOT THE BILL FOR EVERYTHING! We pay for them on a daily basis. They get moved to the head of the line, for emergency procedures.. in front of us..They have babies here NOT EVEN PAYING for the BIRTH..and the baby automatically becomes a citizen.. They take jobs, they take advantage, they steal and IGNORE our laws..NOW ask yourself..and ask BARACK why NOT ENFORCE THE LAWS?? Why not defend the USA?? In a decision that could lay the groundwork for an Arizona-style immigration policy, Virginia's attorney general said state law enforcement officers are allowed to check the immigration status of anyone "stopped or arrested."

Attorney General Ken Cuccinelli issued the legal opinion Friday extending that authority to Virginia police in response to an inquiry over whether his state could mirror the policies passed into law in Arizona.

"It is my opinion that Virginia law enforcement officers, including conservation officers may, like Arizona police officers, inquire into the immigration status of persons stopped or arrested," he wrote.

The decision comes after a federal judge blocked Arizona from implementing its provision that would require law enforcement to check the immigration status of anyone they stop and suspect of being an illegal immigrant.

Cuccinelli's ruling could justify that kind of policy in Virginia. However, Cuccinelli reiterated in the opinion a prior finding that while state officers have the authority to arrest suspects on criminal immigration violations, they are advised against arresting over civil immigration violations. Overstaying a visa would fall under the latter category.

The state's top attorney wrote the opinion in response to a question from state Del. Bob Marshall, who represents Prince William County.

Marshall's county implemented a law that requires police to check the immigration status of everyone they arrest -- but not everyone they come in legal contact with.

One thing that could eliminate all of this, is to have them check ID on everybody that is questioned about anything, that would eliminate any racial overtones. I think they do this anyway. I would guess that illegals won't have any documentation on them - or an expired visa.
It is my understanding that illegals can get drivers licenses, depending on the state.
Perhaps it's time for us to have a National ID card. I was against it, before I was for it. I am warming to the idea. Something foolproof with a fingerprint and photo on it. I would not be for it, unless they eliminate the anchor babies tho.
Otherwise, who carries their birth certificate with them? I don't. I don't even carry a purse. I carry my 2 credit cards, my Safeway card, and my drivers license in my pocket. That's it. My car has all the proof of insurance etc.
Or, lets just adopt Mexico's laws, to honor their culture.

This could be a recreation of events that led to the Civil War.

Too bad that Obama and his "Team" and most of Congress and the Senate were all trained Lawyers. They are sht hot at writing 2,000+ page Laws at 2 am, and know Das Kapital and Saul Alynsky by heart:
